This Privacy Policy ("Policy") describes the information collected ("Collected Data") by or on behalf of Oasis Speech PLLC ("Oasis Speech," "we," "us," or "our") through our website (the "Site"), our forms, and our communications and services, including telehealth speech-language pathology services in Florida and Texas. This Policy also includes required disclosures for SMS/text messaging.

By using the Site or providing information to Oasis Speech, you agree on behalf of yourself and any organization you represent (together, "you") that you have read and understand this Policy. We may modify this Policy at any time. All changes will be effective immediately upon posting to the Site. Material changes will be conspicuously posted on the Site or otherwise communicated to you.

1. Scope and Relationship to HIPAA

Oasis Speech is a healthcare provider. If you are a patient (or a parent/guardian of a patient), certain information you provide may be Protected Health Information ("PHI") under the Health Insurance Portability and Accountability Act (HIPAA). Our HIPAA Notice of Privacy Practices describes how we use and disclose PHI for treatment, payment, and healthcare operations, and outlines your rights regarding PHI. Where applicable, HIPAA and state privacy laws may provide additional protections beyond this Policy.

2. Site Terms

If you use the Site, you must also comply with our Terms of Use ("Terms").

3. Collected Data We Collect

We collect Collected Data from you in several ways: (A) data you provide, and (B) data collected automatically.

A. Data You Provide

You can visit the Site without submitting Personal Information. If you elect to provide information, we may collect:

·         Personal Information: name, email, mailing address, phone number, birthdate, and similar identifiers.

·         Health and Insurance Information: medical history details, therapy needs, and insurance information (e.g., payer name, member ID, group number), when provided.

·         Employment Information: information submitted when applying for a role with Oasis Speech (used to evaluate applications). If hired, certain profile information may be displayed publicly if applicable.

·         Client Account Information: information used to create and maintain your account in our practice management software (e.g., patient name, gender, date of birth, contact details, and related intake information).

·         Payment Data: billing name and address and related transaction information. Payment card processing is typically handled by third-party processors through our practice management software. We may retain limited payment-related data (e.g., last four digits) for administrative purposes. We do not intentionally store full card numbers in our own systems.

B. Data Automatically Collected

When you use the Site, we and our vendors may automatically collect certain information, including:

·         Non-Personal Information: IP address, approximate location, device identifiers, browser type, pages visited, referring/exit pages, and usage timestamps.

·         Account Activity: data about how you use your account or the Site when logged in.

·         Cookies and Similar Technologies: cookies, pixels, web beacons, and similar tools that collect usage and preference information.

Cookies may be first-party (set by our Site) or third-party (set by vendors such as analytics providers). We do not control third-party cookies, and they are not governed by this Policy. Most browsers automatically accept cookies, but you can modify your browser settings to manage cookies. Disabling cookies may impact Site functionality.

Do Not Track: We currently do not honor "Do Not Track" signals.

C. Analytics and Advertising

We may use analytics tools (such as Google Analytics) to help us understand Site performance and improve content and functionality. We may also use advertising tools (such as Google Ads) and other vendors to measure and deliver advertising. These tools may use cookies or similar technologies.

You can learn more about Google’s practices and available controls through Google’s privacy and ad settings. If we use other analytics or advertising vendors, their tools may have separate opt-out mechanisms.

4. How We Use Collected Data

We may use Collected Data for purposes including:

·         As stated or agreed to at the point of collection (e.g., responding to inquiries, scheduling, providing services).

·         Treatment and care coordination, including telehealth services and administrative support.

·         Insurance verification, claims submission, billing, payment processing, and related administration (as applicable).

·         Operating and improving the Site, troubleshooting, analytics, and customizing your user experience.

·         Practice operations, quality improvement, training, compliance, auditing, and business planning.

·         Protecting our rights, preventing fraud, ensuring security, and enforcing our Terms and policies.

·         Marketing communications only if you opt in (see Section 6).

5. Disclosure of Collected Data

We do not sell, rent, or lease your Personal Information to third parties. We may share Collected Data as follows, consistent with applicable law:

A. Employees and Affiliates

We may share Collected Data with employees and affiliates who need the information for business or clinical purposes, including within our therapy team.

B. Service Providers (Vendors)

We may share Collected Data with third-party service providers, suppliers, consultants, agents, partners, and representatives (collectively, "Service Providers") that perform services for us, such as website hosting, telehealth platforms, practice management systems, secure communications, billing support, payment processing, IT support, analytics, and security. Service Providers are expected to protect Collected Data and use it only to provide services for us.

C. Insurance Providers and Payers (If Applicable)

We may share relevant Personal Information and Health/Insurance Information with your insurer or payer to verify coverage, request authorizations, submit claims, obtain payment, and perform related insurance administration.

D. Legal, Safety, and Compliance

We may disclose Collected Data when we believe in good faith that disclosure is required by law, court order, subpoena, or other lawful process; to cooperate with law enforcement or governmental agencies; to protect the rights, safety, and security of Oasis Speech, our patients, our users, or others; or as advised by legal counsel.

E. Professional Advisors

We may share Collected Data with our professional advisors (e.g., attorneys, accountants) in their capacity as advisors to Oasis Speech.

F. Change in Ownership

If Oasis Speech or the Site is involved in a merger, acquisition, sale, bankruptcy, receivership, or similar transaction, Collected Data may be transferred as part of that transaction, subject to applicable law.

G. Non-Personal / De-Identified Information

We may collect, use, share, transfer, and otherwise process Non-Personal Information for legitimate business purposes in compliance with applicable laws. If we de-identify information so it is no longer reasonably identifiable, we may treat it as Non-Personal Information.

6. Marketing Communications; Opt Out

If you opt in to receive marketing communications, we may use your contact information to send promotions or updates. You may opt out of marketing emails by using the unsubscribe link in the email or by contacting us at admin@oasisspeech.com with “Unsubscribe” in the subject line. Opting out of marketing communications does not opt you out of important service, account, or transaction messages.

7. SMS/Text Messaging Privacy, Data Sharing, and Terms (Carrier Requirement)

If you choose to receive text messages from us, the following applies:

A. Data Sharing (Required)

·         Customer data is not shared with 3rd parties for promotional or marketing purposes.

·         Mobile opt-in and consent are never shared with anyone for any purpose. Any information sharing that may be mentioned elsewhere in this policy excludes mobile opt-in data.

B. Messaging Terms and Conditions (Required)

By providing your phone number and agreeing to receive texts, you consent to receive text messages from Oasis Speech, from 863-663-2944, regarding customer care. Consent is not a condition of purchase. Message frequency varies. Message & data rates may apply. You can reply STOP to unsubscribe at any time or HELP for assistance. You can also contact us at 863-663-2944 or admin@oasisspeech.com. Mobile opt-in information is never shared with third parties.

C. Security Note

Text messaging is not always secure. Please do not send sensitive medical details or PHI by SMS. If you need to discuss clinical information, we can use more secure channels.

8. Limited Collection of Sensitive Data

“Sensitive Data” may include information about racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, health information, sexual orientation, or similar sensitive categories. It is solely at your option to provide Sensitive Data unless it is required to deliver services (for example, health history information needed for evaluation and treatment). Please do not send Sensitive Data that we do not expressly request.

9. Children’s Privacy

The Site is not intended for use by anyone under the age of eighteen (18) (or the age of majority in the state where they reside). We do not intend to collect Personal Information from children through the Site. Pediatric services are provided with parent/guardian involvement through appropriate intake processes.

10. Data Security

We use commercially reasonable administrative, technical, and organizational measures to help secure Collected Data against loss, misuse, and alteration appropriate to the type of data processed. If a breach occurs, we will notify you if required under applicable law. However, no method of transmission over the internet or mobile networks can be guaranteed to be 100% secure.

11. Data Retention

We retain Collected Data only as long as necessary for legitimate business, clinical, and legal purposes, including healthcare recordkeeping requirements.

12. Access From Outside the United States

If you access the Site from outside the United States, Collected Data may be transferred to, stored in, and processed in the United States.

13. Governing Law and Venue

This Policy is governed by the laws of the State of Florida, without regard to conflict of laws principles, except where Texas law applies to services provided to Texas residents or as otherwise required by applicable law. You agree that any dispute arising under this Policy or related to the Site will be brought in the state or federal courts located in [COUNTY], Florida, and you consent to personal jurisdiction and venue in those courts, unless prohibited by applicable law.

14. Third-Party Websites and Social Media

The Site may link to, or be linked from, websites not controlled by us. We are not responsible for third parties’ privacy policies or practices. Your use of social media platforms is governed by the privacy policies and terms of those platforms. Anything you post on social media may be public and not treated confidentially.

To access or update your information as it exists in our records, please contact us using the information below. If you are a patient, additional rights regarding PHI may apply under HIPAA (see our Notice of Privacy Practices).
